| dc.description | This report aims to analyse the main generalities of the multi-level protection of fundamental worker rights, through a comparative analysis between Spain and Colombia. It was determined that working in Spain requires a set of rights and responsibilities that both employers and employees must be aware of in order to guarantee a fair work environment and comply with all applicable laws throughout the Spanish territory. With the multi-level protection of rights, great progress is being made in much of the European region, but to the extent that this protection is effective, it can lead to more complete legal protection at the national level. In this constant interaction, one can imagine that there is an auxiliary relationship between different systems, so that one system can help, complement, add to or even replace the other if one of them fails. There are many national and international scholars who see it this way and highlight the importance of a symbiotic relationship between the different legal systems in addition to the American human rights system, thus recognizing the benefit that this transversal and multi-level interaction of the laws that protect them and that are structurally based on the principles of human rights brings to employees and workers, where all rights within the framework of Justice must be guided by the most favorable interpretation of the national and international norms that protect human rights. | dc.description | Con este informe se busca analizar las principales generalidades de la protección multinivel de los derechos fundamentales del trabajador, a través de un análisis comparativo entre España y Colombia. Se pudo determinar que trabajar en España requiere un conjunto de derechos y responsabilidades que tanto empleadores como empleados deben conocer para garantizar un ambiente de trabajo justo y cumplir con todas las leyes aplicables a lo largo de todo el territorio español. Con la protección multinivel de los derechos, se da un gran avance en gran parte de la región europea, pero en la medida en la que esta protección sea efectiva, puede conducir a una protección legal más completa a nivel nacional. En esta interacción constante, uno puede imaginar que existe una relación auxiliar entre diferentes sistemas, de modo que un sistema puede ayudar, complementar, adicionar o incluso suplir al otro si uno de ellos quiebra. Siendo varios los doctrinantes nacionales e internacionales que así lo ven y resaltan la importancia de una relación simbiótica entre los diferentes sistemas jurídicos en complemento con el sistema americano de los DDHH, reconociendo así el beneficio que trae para los empleados y trabajadores esta interacción transversal y multinivel de las leyes que los cuidan y que se fundan estructuralmente en los principios de los DDHH, donde todos los derechos en el marco de Justicia, debe guiarse por la interpretación más favorable de las normas del orden nacional e internacional que protegen los derechos humanos.
