dc.descriptionThe present article analyzes the importance of international cooperation for the effective functioning of the International Criminal Court (ICC). The ICC, established under the Rome Statute, relies heavily on the collaboration of nations to fulfill its mandate of investigating, executing arrest warrants, and conducting trials against those responsible for serious international crimes such as genocide, war crimes, and crimes against humanity. The article points out that while some states actively cooperate with the ICC, others show resistance, particularly those that are not signatories to the Rome Statute. The lack of cooperation, due to reasons of sovereignty or political motivations, has hindered the work of the ICC, perpetuating impunity and affecting its credibility. The study also reviews various cases where the lack of cooperation has prevented the capture and trial of accused figures, such as former Sudanese President Omar al-Bashir and Libyan leader Saif al-Islam Gaddafi, highlighting the Court’s operational weakness in the absence of effective coercive mechanisms. The article concludes by emphasizing the importance of strengthening cooperation mechanisms, both at the legal and diplomatic levels, which is crucial for the consolidation of the international criminal justice system. It proposes recommendations to improve collaboration between the ICC and states. This approach not only helps to understand the challenges faced by the ICC but also suggests measures to ensure that those responsible for these heinous crimes are brought to justice, thereby guaranteeing the Court's effectivenessen
dc.descriptionEl presente artículo analiza la importancia de la cooperación internacional para el funcionamiento efectivo de la Corte Penal Internacional (CPI). La CPI, instituida bajo el Estatuto de Roma, depende en gran medida de la colaboración de las Naciones para cumplir con su objetivo de investigar, ejecutar órdenes de arresto y realizar juicios contra los responsables de delitos internacionales graves como genocidio, crímenes de guerra y crímenes de lesa humanidad. El artículo señala que, si bien algunos Estados cooperan activamente con la CPI, otros muestran resistencia, especialmente aquellos que no son signatarios del Estatuto de Roma. La negligencia de cooperación, por razones de soberanía o motivaciones políticas, ha obstaculizado la labor de la CPI, perpetuando la impunidad y afectando su credibilidad. El estudio también revisa diferentes casos en donde la falta de cooperación ha impedido la captura y juicio de figuras acusadas, como el expresidente sudanés Omar al-Bashir y el líder libio Saif al-Islam Gaddafi, destacando la debilidad operativa de la Corte en ausencia de mecanismos coercitivos efectivos. El artículo concluye resaltando la importancia de fortalecer los mecanismos de cooperación, tanto a nivel legal como diplomático, lo cual es crucial para un afianzamiento del sistema de justicia penal internacional, y propone recomendaciones para mejorar la colaboración entre la CPI y los Estados. Este enfoque permite no solo entender los retos que enfrenta la CPI, sino también propone medidas para asegurar que los responsables de estos delitos atroces enfrenten la justicia, garantizando así la efectividad de la Corte.es
